Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the HOPE Workspace platform (the “Service”) operated by HOPE (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you are agreeing on behalf of an organisation, you represent that you have authority to bind it.
1. The Service
HOPE provides an agency operations workspace (projects, tasks, calendar, finance, files and related tools) delivered as a hosted, multi-tenant application. Each customer workspace is logically isolated from every other workspace.
2. Accounts
You are responsible for your account credentials and for all activity under your account. Notify us promptly of any unauthorised use. You must provide accurate registration information and keep it current.
3. Acceptable use
- Do not use the Service unlawfully, or to store or transmit unlawful, infringing, or harmful content.
- Do not attempt to access another customer’s workspace or data, probe or breach security or authentication measures, or disrupt the Service.
- Do not reverse-engineer, resell, or provide the Service to third parties except as expressly permitted.
4. Subscriptions, trials and billing
Paid plans are billed in advance on a recurring basis through our payment processor. Where a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled beforehand; a valid payment method may be required to start a trial. You authorise recurring charges until you cancel. Fees are non-refundable except where required by law. We may change pricing on renewal with prior notice.
5. Cancellation and suspension
You may cancel at any time; access continues until the end of the current billing period. We may suspend or limit access for non-payment, or for a breach of these Terms, and may terminate for material or repeated breach.
6. Your data
You retain all rights to the content and data you submit (“Customer Data”). You grant us a limited licence to host and process Customer Data solely to provide the Service. Our handling of personal data is described in our Privacy Policy and, where applicable, our Data Processing Addendum. You may export or request deletion of your workspace data as described there.
7. Third-party integrations
The Service can connect to third-party services (e.g. Google, Slack, Asana, Frame.io) at your direction. Your use of those services is governed by their own terms; we are not responsible for third-party services.
8. Warranties and disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our aggregate liability arising out of or related to the Service will not exceed the amounts you paid us in the twelve months preceding the claim.
10. Changes
We may update these Terms; we will post the updated version with a new effective date and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.
11. Governing law & contact
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws rules. Questions: legal@thehope.io.
